WRITTEN WARRANTY TERMS

Limited Lifetime
Workmanship Warranty

We stand behind qualifying installation work performed by Medicine Hat Exteriors. These terms explain what is covered, what is not covered, how long coverage lasts, and how to request service.

Important: This workmanship warranty is limited and is separate from every product manufacturer’s warranty. It does not replace, reduce, extend or modify manufacturer coverage or any right or remedy that cannot legally be excluded under applicable law.

1. Who provides this warranty

This limited warranty is provided by Medicine Hat Exteriors (“MHE,” “we,” “us” or “our”) to the original customer identified in an MHE written contract or paid invoice (“you” or the “customer”) for qualifying work completed at the property identified in that document.

2. Meaning of “limited lifetime”

“Lifetime” means the ordinary service life of the specific product or component installed by MHE while it remains installed at the original property. It does not mean the lifetime of the customer, the building, MHE or any replacement product. Coverage ends when the covered product is removed, replaced, altered beyond ordinary maintenance, reaches the end of its ordinary service life, or when coverage otherwise ends under these terms.

3. What is covered

Subject to all eligibility requirements, exclusions and limitations below, MHE warrants that qualifying installation work performed and invoiced by MHE will be completed in a workmanlike manner. If MHE determines after inspection that a failure was directly caused by MHE’s improper installation, MHE will correct the covered workmanship defect at no additional charge for the labour and ordinary materials reasonably necessary to perform that covered repair.

This is a repair warranty. It is not an unconditional promise that a roof, exterior system or building will never leak, move, wear, deteriorate or require maintenance.

4. Eligibility

  • The work must have been performed directly by MHE and identified in an MHE written contract or paid invoice.
  • All amounts owing for the project must have been paid in full.
  • The customer must use and maintain the property and installed products reasonably and in accordance with manufacturer instructions.
  • The customer must give prompt written notice after discovering a suspected workmanship issue, take reasonable steps to prevent further damage, and provide safe and reasonable access for inspection and repair.
  • Unless MHE agrees otherwise in writing, this warranty is for the original customer and original property and is not transferable.

5. Manufacturer warranties remain separate

Roofing, siding, metalwork, sealants, fasteners, fixtures and other products may carry warranties provided by their manufacturers. Those warranties remain subject exclusively to the manufacturer’s own registration requirements, duration, exclusions, remedies and claim procedures. MHE does not adopt, expand or guarantee a manufacturer’s obligations and is not responsible for a manufacturer’s denial, delay, insolvency, discontinued product or inability to provide a matching replacement.

6. What is not covered

To the fullest extent permitted by law, this workmanship warranty does not cover:

  • Manufacturing or product defects, ordinary wear and tear, normal aging, fading, chalking, staining, corrosion, shrinkage, expansion, cosmetic variation or the end of a product’s service life.
  • Damage or failure caused by hail, lightning, wildfire, flood, extreme wind, ice, snow load, falling objects, animals, pests, vandalism, accident, misuse, negligence, abuse or any other event beyond MHE’s reasonable control.
  • Condensation, attic moisture, ice dams, inadequate ventilation, humidity, mould, rot or environmental contamination unless directly and solely caused by covered MHE workmanship.
  • Building movement, settlement, vibration, structural failure, design or engineering defects, deficient framing, decking, sheathing, insulation, foundation or substrate, or concealed and pre-existing conditions.
  • Leaks or damage originating from windows, doors, masonry, plumbing, HVAC, chimneys, skylights, solar equipment, antennas, satellite equipment or portions of the building not installed by MHE.
  • Alteration, penetration, repair, maintenance or interference by the owner or any third party, including another contractor, after MHE completes the work.
  • Failure to perform reasonable maintenance, keep drainage paths clear, address known damage promptly, or mitigate further loss.
  • Work, materials or conditions expressly excluded from MHE’s written scope, and temporary or emergency repairs unless a written warranty is expressly provided for that work.
  • Differences in colour, gloss, texture or profile, or the inability to obtain an exact product match due to weathering, batch variation, product changes or discontinuation.

7. How to make a claim

  1. Email medhatexteriors@gmail.com or call 403-928-5186 promptly after discovering the issue.
  2. Provide your name, property address, invoice or contract information, a description of the issue, when it was first observed, and photographs or other reasonably requested information.
  3. Allow MHE a reasonable opportunity to inspect before permanent repairs are made. Emergency work reasonably necessary to protect people or prevent immediate further damage may be undertaken, but the customer should document the condition and notify MHE as soon as reasonably possible.

MHE may investigate the cause, consult the manufacturer or other qualified persons, and require reasonable evidence before accepting a claim. Inspection does not by itself mean that a claim has been accepted.

8. Remedy and performance

For an accepted claim, MHE will determine a reasonable repair method consistent with applicable requirements and available materials. MHE may repair or reperform the affected portion of covered work and, where reasonably necessary, replace affected components. The warranty does not require replacement of unaffected work, an entire elevation or an entire roofing system solely to achieve a uniform appearance.

MHE will perform accepted warranty work within a reasonable time considering weather, safety, material availability and scheduling. No cash refund, upgrade or credit is provided unless MHE agrees in writing or applicable law requires otherwise.

9. Limits on damages and liability

Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited. Subject to that rule, MHE’s obligation under this warranty is limited to correcting the covered workmanship defect as described above. To the fullest extent permitted by law, MHE is not liable under this warranty for indirect, incidental, special, exemplary, punitive or consequential loss, including loss of use, lost income, lost profit, loss of enjoyment or diminution in value.

To the fullest extent permitted by law, any liability beyond the repair remedy for a covered claim will not exceed the amount actually paid to MHE for the affected portion of the original work giving rise to the claim. The customer remains responsible for reasonable steps to protect the property and minimize avoidable damage.

10. Other terms

  • This warranty is governed by the laws of Alberta and the federal laws of Canada applicable in Alberta.
  • If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply.
  • No employee, installer or representative may expand this warranty orally. A change must be in writing and authorized by MHE.
  • The warranty terms in effect when the customer’s written contract is entered into will govern that project unless the parties agree otherwise in writing.
  • This warranty is in addition to, and does not replace, any non-waivable rights or remedies under applicable consumer-protection law.

Proposed effective date: October 23, 2026. These website terms are a general summary and should be incorporated into each customer’s written contract or warranty certificate. Medicine Hat Exteriors should obtain independent Alberta legal advice before relying on these terms.
